MARITIME INSURANCE

WHY INSURE YOUR CARGO? This photo is real. The term ‘Cargo Insurance’ is used to refer to the insurance of goods, which are transported by sea, air, land or rail. Cargo insurance provides protection for losses caused by or resulting from loss of goods whilst in transit. Accidents still occur in spite of the improvements made in the safety of transportation. With proper Cargo Insurance you are protecting yourself against:

  • Theft, Pilferage, Non-Delivery, Leakage, Shortage, Condemnation
  • Marine Hazards e.g. Sinking, Stranding, Collision, Jettison, Fresh Water, Sea Water, Hijacking
  • Breakage, Explosion, Improper Stowage
  • Acts of God: Damage or Deterioration due to Bad Weather, War Risk, Capture & Seizure Risk
  • Burning; Strikes, Riots & Civil Commotion; Condensation etc.
  • Carrier, forwarders, etc., through whose hands the goods pass, accept only limited liability

It is also important for the cargo owner to remember:

  • The cost of insurance is only a small portion of the total transport cost.
  • Insurance remains in force for a limited number of days (between 15 – 60 days depending on insurers), after vessel discharge or delivery, whichever occurs first.
  • The cargo owner MUST therefore notify and pay the additional premium in advance to the insurer if a longer period is required.
  • Concealed damage must be reported within three (3) days of delivery, excluding Saturdays, Sundays and holidays

COVERAGE

Cargo is protected on an "all risk" basis against all risk of physical loss or damage from any external cause, irrespective of percentage loss.

Port to Port: Coverage commences from the time the shipper, supplier
and/or his Freight Forwarder delivers the cargo to the nominated Carrier at the port or point of loading of the Carrier at Origin, as instructed by the Carrier and continues in force during the ordinary and customary course of transit to the final port of destination.

Note: Coverage ends once cargo leaves the port at destination

Warehouse to Warehouse: Coverage commences from the time the road haulier picks-up
the cargo (container) at the shipper, supplier and or his Freight Forwarder's warehouse in the country of origin and continues during transit by sea or air.
Coverage ends when the consignee receives his/her cargo, at his warehouse at destination.

RISKS NOT COVERED BY INSURANCE

There are a number of circumstances which are excluded from coverage.
These are generally categorized under: (a) Inherent vice of goods
(b) Inadequate packing
 (c) Delays
(d) Willful misconduct and/or fault of the insured
(e) Normal wear and tear

It is also important to remember that, under NO circumstances, will the marine insurer be liable for losses resulting from: (a) Variations in rates of exchange
(b) Demurrage,
(c) Rent/Port Storage
 (d) Insured Party's fault of misconduct e.g., smuggling or contraband, false declaration, infringement of trade regulations and so forth.
